Regulatory Sunset

Regulatory sunset provisions are critical to reducing the burden outdated and obsolete regulations often place on consumers and businesses. By placing an expiration date on every regulation, and requiring a review of that regulation’s performance upon expiration, state’s can greatly improve regulatory health. Many regulations either never undergo review, or when they do, it is not subject to previous data or expiration requirements, resulting in bad regulations staying on the books. Sunset review should compare data and observations from the rule’s promulgation to its expiration, enabling the state to draw conclusions that would otherwise be missed. Should that agency choose to reissue the expired regulation, they would be empowered to adapt the regulation in light of this comprehensive review.
